Welcome to FasHub ("Company," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and FasHub governing your access to and use of our platform, website, mobile applications, and services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.
2.1 Age Requirement: You must be at least 18 years of age to use our Services. By using FasHub, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2.2 Account Creation: To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
2.4 Professional Verification: Fashion designers and tailors must undergo our verification process to offer services on the platform. We reserve the right to verify credentials, work history, and professional qualifications at our discretion.

4.1 Platform Role: FasHub operates as an intermediary platform connecting individuals with fashion designers and tailors. We are not a party to the actual service agreements between users and professionals.
4.2 No Guarantee: We do not guarantee the quality, safety, or legality of services provided by professionals on our platform. Users engage with professionals at their own risk.
4.3 Dispute Resolution: While we may assist in facilitating dispute resolution between users, we are not obligated to resolve disputes and assume no liability for outcomes.
5.1 Service Fees: FasHub charges service fees for facilitating connections and transactions between users and professionals. All fees are clearly displayed before you complete a transaction.
5.2 Payment Processing: Payments are processed through third-party payment processors. You agree to comply with their terms and conditions.
5.3 Refunds and Cancellations: Refund policies are determined by the individual professionals providing services. FasHub's service fees are generally non-refundable unless otherwise stated.
5.4 Taxes: You are responsible for determining and paying any applicable taxes arising from your use of the Services.
6.1 Platform Content: All content on the FasHub platform, including text, graphics, logos, images, software, and compilation, is the property of FasHub or its licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 User Content License: By posting content on our platform, you grant FasHub a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with operating and promoting the Services.
6.3 Retention of Rights: You retain all ownership rights to your content. However, you are responsible for ensuring you have all necessary rights to grant the license described above.
Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to our data practices as described in the Privacy Policy.
8.1 Service "As Is": THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
8.3 Maximum Liability: Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of $100 USD or the amount you paid to FasHub in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless FasHub, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.
10.1 Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
10.2 Termination by Us: We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
10.3 Effect of Termination: Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FasHub is registered, without regard to its conflict of law provisions.
11.2 Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.
11.3 Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and FasHub individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
